1. About sell.biz.pk

• sell.biz.pk is an online multi-vendor marketplace in Pakistan. Independent vendors list and sell their own products through their stores on the marketplace.
• We provide the marketplace. Unless a page clearly says otherwise, sell.biz.pk is not the seller of the products listed. The sale of a product is between the customer and the vendor shown on the product page.
• Vendors decide their own products, prices, stock, discounts, delivery cities and return options, and are responsible for them.

2. Eligibility and Accounts

• You must be at least 18 years old to sell on sell.biz.pk. To buy, you must be at least 18, or at least 13 and using the Services with the involvement of a parent or guardian.
• You must give accurate information and keep it up to date. Accounts are verified by a one-time code or a link sent to your email address.
• You can also sign up with Google. A Google account has no password on sell.biz.pk and can only sign in with Google, and customers must open the link we email them before placing an order. An email that already has a password account must keep signing in with its password.
• You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you believe your account has been used without your permission.
• Customers can delete their account from their account settings. Records we must keep, such as orders and legal records, may be retained as described in our Privacy Policy.

3. Using Our Services

You agree to use the Services lawfully and fairly. You must not:

• Break any applicable law, or post false, misleading or fraudulent information.
• Impersonate another person or business, or misrepresent your connection with them.
• Place fake orders, repeatedly refuse Cash on Delivery orders, or write fake reviews or ratings.
• Misuse cashback, coupons, referral links or returns, including creating several accounts to gain rewards.
• Harass, threaten, abuse, spam or scam other users, including through chat.
• Collect information about other users without their consent, or use customer details for anything other than fulfilling their order.
• Move a transaction off the marketplace to avoid our rules or fees.
• Buy, sell or arrange the sale of anything prohibited by our Restricted Items Policy.
• Upload viruses or malicious code, get around security measures, or interfere with the operation of the Services.
• Use bots, scrapers or other automated means to access the Services without our written permission.

4. Orders, Prices and Payment (Customers)

• Prices are shown in Pakistani Rupees (PKR). Any delivery charge and discount is shown at checkout before you confirm your order.
• Payment on sell.biz.pk is currently by Cash on Delivery: you pay the full order amount when your order is delivered. We do not take card payments from customers for orders.
• You can order as a guest by confirming a code sent to your email address. Guests can track their orders, but cashback and some other features need an account.
• Your order is a request to buy. The vendor can accept or reject it, for example if a product is out of stock or cannot be delivered to your city. You will be told about changes to your order status.
• Products can become unavailable after you add them to your cart, including when a store goes offline. Unavailable products cannot be ordered.
• If a price or product detail is clearly wrong, the vendor may reject the order, and no payment will be due for it.
• Please give a correct address and phone number, and be available to receive your order and pay for it.

5. Delivery and Order Cancellation

• Vendors pack and dispatch orders using courier and logistics partners. Delivery times are estimates and can be affected by things outside the vendor’s control.
• Each vendor chooses the cities it delivers to, its delivery charges and any free delivery offer.
• You can cancel an order until it has been dispatched. Once it has been dispatched, it can no longer be cancelled.

6. Returns, Refunds and Replacements

Our Return & Refund Policy forms part of these Terms. In summary:

• You can request a return or replacement within 14 days of delivery if the product has a 14-day return policy. Each vendor chooses this for its products, and it is shown on the product.
• Items bought on a cashback deal, paid for with wallet cashback or coins, or bought through a referral link can be replaced but not returned for a refund. Checkout tells you when this applies.
• The vendor reviews your request and approves or rejects it. If the vendor rejects it and you disagree, you can send it to our team, whose decision is final for the marketplace.
• Your statutory rights under the laws of Pakistan are not affected.

7. Cashback, Coupons and Discounts

• Cashback is offered by vendors on selected products, for the dates set by the vendor. It is only for registered customers. Guest orders do not earn cashback.
• Cashback is added to your Cashback Wallet after your order is delivered. If an order is cancelled, no cashback is added and any cashback you used is returned to your wallet.
• Cashback can only be used on products from the store where you earned it. It has no cash value and cannot be withdrawn, sold or moved to another store or person.
• Items from a store where you use your wallet cashback do not earn new cashback.
• Discounts and coupons are set by vendors or by us, and have their own conditions such as dates and a minimum order amount. Checkout tells you if a coupon cannot be used.

8. Referral Marketing (Share & Earn)

• Products with a referral offer can be shared by signed-in customers using a personal Share & Earn link.
• You earn the coins shown on the product when another person buys through your link during the vendor’s offer period. Buying through your own link earns nothing.
• Coins are added as cashback after the order is delivered, and follow the cashback rules above. Pending coins are not earned until then, and are not earned if the order is cancelled or rejected.
• When a referral offer ends, the product can no longer be shared to earn coins. Coins you have already earned stay in your wallet for that store until you use them, and coins pending on orders placed during the offer are still added when the order is delivered.
• You must share honestly. You must not spam people, make false claims about a product, or pretend to be the vendor or sell.biz.pk.
• We may withhold or remove coins earned through fake orders or misuse.

9. Reviews, Chat and Reports

• Reviews and ratings must be honest and based on your real experience. We may remove reviews that are fake, abusive, or unrelated to the product or store.
• Chat lets customers and vendors talk about products and orders. Please do not share passwords or payment card details in chat.
• You can report a problem with a product, store, vendor or user through your account or by contacting us. Reports may be shared with the people involved so they can be resolved.

10. Vendor Applications and Stores

• To sell, you must apply with accurate identity, business and contact details, including your CNIC, selling categories and bank details. Your store goes live only after our team approves your application. We may reject an application.
• You are responsible for everything done through your vendor account, including by workers you add to it.
• Customer details are given to you only to fulfil and support the customer’s order. You must protect them and comply with our Privacy Policy and applicable law.

11. Vendor Subscription and Fees

• Selling works on a monthly subscription. We do not take a share of your sales. The monthly fee depends on the main product categories you sell in, and there is no charge for delivery cities.
• Your first 60 days after approval are free. After that, you pay the fee each month from your Subscription page through our payment provider, PayFast. Your card details are entered on PayFast and are not saved by us, and nothing is charged automatically.
• You can pay up to 7 days before the due date. If the fee is not paid by the due date, you have a 3-day grace period to pay.
• If it is still unpaid after the grace period, your store and products go offline for all customers, and your seller panel is limited to your Subscription page and orders already placed, until you pay. Your products and data are kept and come back once you pay.
• You can cancel anytime from your Subscription page. Your store stays active until the end of the period already paid for, and then goes offline. Fees already paid are not refunded for partial months.
• Promotion fees, such as for banners, are separate and are paid through PayFast when you apply for or confirm a promotion.
• We may change fees. We will tell you before your next payment is due.

12. Vendor Listings, Orders and Payments

• Every listing, store page and promotion must follow our Listing Ad Policy and Restricted Items Policy, which form part of these Terms.
• You must only sell products you have the right to sell, keep stock and prices accurate, and honour the price shown when an order was placed.
• You must accept or reject orders promptly, dispatch them on time, keep tracking up to date, and provide any warranty you promise.
• You must review return, refund and replacement requests fairly, and follow our team’s decision if a dispute is sent to us.
• Because orders are Cash on Delivery, sell.biz.pk does not collect or hold order payments or pay them out to you. Arranging collection of the order amount with your courier is your responsibility.
• The cashback, coupons, discounts and referral rewards you offer must be honoured for orders placed during the offer, and their cost is yours.
• You are responsible for your own taxes and for the licences and approvals your business and products need.

13. Payments Through Third Parties

Some services are provided by third parties, such as PayFast for vendor payments and couriers for delivery. They have their own terms, and we are not responsible for their services. We never see or store your full card number or CVV.

14. Suspension and Termination

• We may remove content, restrict features, or suspend or close an account or store if we believe these Terms or our policies have been broken, to protect users or the marketplace, or if the law requires it.
• This can include repeated customer complaints, fraud or misuse. Where appropriate, we will tell you the reason, and vendors may be warned first.
• We have the right, but not the obligation, to monitor activity and content on the Services.
• Orders, returns and amounts owed before an account is closed must still be completed or settled.

15. Intellectual Property

• The sell.biz.pk name, logo, website, software and our own content belong to us or our licensors and are protected by law. You may not use them without our written permission.
• You keep ownership of the content you post, such as product photos, descriptions, store designs and reviews. You give us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display it to operate and promote the Services.
• You confirm you have the right to post your content and give this licence, and that it does not infringe anyone’s rights. If you believe content infringes your rights, please contact us.

16. Privacy

Our Privacy Policy explains how we collect, use and share personal information, including sharing delivery details with vendors and couriers to fulfil orders.

17. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT THE LAW ALLOWS. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT VENDORS, THEIR LISTINGS OR THEIR PRODUCTS ARE ACCURATE, SAFE OR LAWFUL.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, RESULTING FROM (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, OUR SERVICES; (B) THE CONDUCT, PRODUCTS OR CONTENT OF ANY VENDOR, CUSTOMER OR OTHER THIRD PARTY; OR (C) UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT OR CONTENT. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

19. Indemnity

You agree to compensate us for claims, losses and costs caused by your breach of these Terms, your content, or, if you are a vendor, your products and your dealings with customers.

20. Events Outside Our Control

We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, internet or power failures, or government action.

21. Governing Law and Disputes

These Terms are governed by the laws of Pakistan. Please contact us first so we can try to resolve any dispute informally. A dispute that cannot be resolved this way will be subject to the jurisdiction of the courts of Pakistan.

22. Changes to These Terms

We may update these Terms from time to time. We will post changes on this page and update the Effective Date, and will tell vendors about important changes before they take effect. We may ask you to agree to the updated Terms to keep using your account. If you continue to use our Services after a change, you accept the updated Terms.

23. Other Terms

If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a right, we do not give it up. You may not transfer your rights or account under these Terms without our permission.
